Not all Privacy Policies are the same and until recently, not many visitors to a website ever paid much attention to what appears to be "legalese" and "boilerplate" language though we've all been familiar with the label "privacy policy."  This is not the case with Chapter 3 Capital and its affiliates ("Chapter 3", "C3C", "we" or "us").  We take privacy seriously and are committed to protecting the privacy of our website visitors.  What that means is that this privacy policy ("Privacy Policy") seeks to help you understand whether and how we collect information about you when you visit our website (the "Site"), and how we use such information. This Privacy Policy does not address our privacy practices concerning any nonpublic personal information we collect as to our investors or the start-ups we support; we address those practices in separate notices sent to our investors and start-ups (both potential and activated).

How We Collect, Use, Share and Protect Your Information

Use of Personally Identifiable Information

When you use the Site, you will have the option to voluntarily submit information to our website that relates to you personally, including your e-mail when combined with other data that can be used to identify a specific individual such as your name or other information that might be available publicly (referred to as "PII" or "Personally Identifiable Information").  The PII you submit to our Site is used only to provide you with further information on our products and/or services, including to send you administrative communications either about your interactions with us or about features of the Site, and to respond to your specific inquiries.  We have not, do not and will not sell, share or rent your PII to others in contravention of this Privacy Policy. We generally record certain usage information, such as the number and frequency of visitors to the Site. Access to and Control Over Your Information

There is no single US Federal Privacy Law.  In the United States, the states set the privacy standards and many Federal different federal laws and frameworks and institutions work in sync and sometimes way out of sync to protect people's privacy rights.  Some of these you've heard of and some you have not but for the most part almost everyone is covered or is impacted by the following:  Federal Trade Commission ("FTC"); Federal Communications Commission ("FCC"); Privacy Act of 1974; Health Insurance Portability and Accountability Act ("HIPPA"); Children's Online Privacy Protection Act ("COPPA"); Fair Credit Reporting Act ("FCRA"); Electronic Communications Privacy Act ("ECPA"); Department of Homeland Security ("DHS") Privacy Office; Consumer Financial Protections Bureau ("CFPB"); and the National Institute of Standards and Technology ("NIST").  We could continue with a list so long you might think we might run out of acronyms and abbreviations.  Nobody lists these laws in their Privacy Policies but Chapter 3 believes transparency, authenticity and a human powered approach to collaboration is the best way to live life, both personally and in business.  So we did it.  We're doing it.  Borrowing with homage perhaps from the character John Wick, we have served, we will be of service.  To the extent required by applicable law, you may have the right to request access to, correct, or delete your personal information. Data Retention

Did you feel the tone shift in the past few paragraphs?  The paragraphs above are written from a defensive perspective…as though some bad actors were trying to do something with the data they pull from our Site (or from Site visitors) that nobody was inviting them to do.  We kept this tone altered language here because while our Privacy Policy is designed to be clear and inclusive, it's also designed to be effective.  We hope that is your experience with it.  

Governing Law and Jurisdiction

This Privacy Policy shall be governed by and construed in accordance with the laws of the United States and the State of California, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to this Privacy Policy or the use of the Site shall be filed only in the state or federal courts located in Los Angeles County, State of California, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.   At this time we can't imagine being embroiled in any litigation between us relating to our Privacy Policy but we learned some time ago to keep our privacy and IP lawyers close by.  They too embrace our Chapter 3 mission and philosophy and are ready to assist in this regard.
